Which Course is Right for Me?

*Note: Because understanding the basic foundation of Section 7 consultation is critical to both the Biological Assessment Essentials course (BAE) and the Essentials of Section 7 Consultation and Biological Opinions Course (ES7C), a certain amount of review/overlap in foundational materials is unavoidable between these two courses.


Biological Assessment Essentials

This course explains and demonstrates the essential principles behind building a Biological Assessment to support consultation under Section 7 of the Endangered Species Act.

The course will explore:

The deconstruction technique for accurately developing an action area and establishing a foundation for the assessment
How to build a clear and defensible rationale for presence or absence of listed species and critical habitat
A systematic method of exploring and describing effects to species and critical habitat
Project effects determination categories and how to assign a project’s effects appropriately
Common weaknesses in assessments that disrupt smooth consultation with the U. S. Fish and Wildlife Service and National Marine Fisheries Service and how to avoid those weaknesses

This course is appropriate for practitioners at all levels, including those new to writing biological assessments, supervisors who review biological assessments, and experienced practitioners who would like to learn additional tips and techniques for better written documents and more efficient consultation.

Course will be provided in an online live webinar format using the ClickMeeting webinar platform. It will consist of approximately 8 hours of live presentation, with lunch and rest breaks, given in one day. An optional 2 hour interactive question and answer session will be scheduled the day following the presentation. Doug Laye will be the course instructor. This course is appropriate for practitioner’s new to the consultation process that need a foundation to build on while writing concurrence letters or biological opinions, practitioners that have been writing consultation documents without any formal training, and supervisors or managers that must review final consultation documents or supervise consultation practitioners.

The Essentials of Section 7 Consultation and Biological Opinions

This course describes the intent, requirements, process and products behind consultation under Section 7 of the Endangered Species Act.

The course will explore:

The Prime Directive of Section 7
The complicating differences between the standards in consultation and the scientific method
Important terms of art
Necessary legal and policy documents to inform the consultation process

The distinction between the categories of project effects determinations

used in consultation, and the consequences of those differences
The importance of clear communication and clear rationales through writing
Areas of common weaknesses in Biological Opinions and Concurrence Letters and methods to strengthen those areas

Essentials of Programmatic Consultations

This course explores and explains programmatic approaches to Section 7 consultation under the Endangered Species Act.

It is strongly recommended that students enrolling in this class have prior training or experience in the Section 7 consultation process.

Course topics include:

How programmatics differ from standard consultations
Ways to understand the confusing naming conventions encountered within programmatic consultations
The 7 steps to establish the foundation of a programmatic approach
Variations in programmatic activity, biological assessments, and programmatic consultation documents
Challenges and vulnerabilities within the programmatic approach and potential solution strategies

This course has been developed for practitioners already familiar with the essentials of Section 7 consultation who would like to add an understanding of programmatic consultations to their skill set.
